Terms and Conditions for Purchasing an Organization Profile and Posting Endorsements

All purchases of Organization Profiles on eVoter are subject to the following terms and conditions in addition to the general Terms and Conditions of eVoter (definitions in these Terms and Conditions are the same as in the general Terms and Conditions of eVoter):

  1. Our current rates for an Organization Profile and posting endorsements are available on Our Price List. Our prices are determined by the number of endorsements your Organization makes per election (i.e. primary or general). You can add additional endorsements at any time by increasing to the next level.
  2. When You purchase an Organizational Profile from Us, You acknowledge that You are purchasing paid political advertising.
  3. Purchases of Organizational Profiles may only be made by Organizations who have formed political action committees and have received an ID number for such committee from the relevant election regulatory authority.
  4. Payment for an Organization Profile may be made by:
    • Check from the Organization's official political action committee.
    • Credit Card.
  5. All purchases will be subject to verification by Us that (i) You are the Organization you purport to be on eVoter and (ii) that Your political action committee details are accurate. We will use our best efforts to verify your information within 3 business days. You agree to provide any additional information we require to perform such verification. In the event we are unable to verify information, we do not issue refunds, but you may provide additional verification information.
  6. You will be able to edit and access Your Organization Profile and select your Candidate endorsements during the period when We are verifying Your information under Section 5, above. However, your Organization Profile and Candidate endorsements will not be visible to other users of eVoter until (i) We have completed verification of your information and (ii) your payment has been received and cleared.
  7. You are responsible for all content on Your Organization Profile. We will not edit or censor the content of Your Organization Profile.
  8. We will identify Your Organization Profile as paid political advertising as required under the relevant campaign finance laws governing Your Organization (such as a notice on the bottom of Your Organization Profile page stating "Paid for by..." in the proper format). However, if such identification does not comply with the relevant laws, You agree that it is Your responsibility to notify Us of such non-compliance and to inform Us how to make any corrections that are needed. We agree to promptly update Your Organization Profile with the correct language/format.
  9. If You opt to accept contributions on Your Organization Profile through CT, You expressly acknowledge that You are soliciting contributions for your campaign committee and that we are not making any solicitations to users of eVoter on your behalf.
  10. All purchases are final. No refund will be given if You wish to remove your Organization Profile prior to an election, regardless of the reason for removal.
  11. Following the election date that you have paid for, we will remove Your Candidate endorsements from eVoter upon 10 business days emailed notice. Your Profile will remain accessible and you will be invited to make additional endorsements for subsequent elections for an additional payment according to Our Price List.
  12. We expressly disclaim any liability for any failure to display Your Organization Profile and Candidate endorsements for any technical reason whatsoever. We do not make any representations as to how many times Your Organization Profile and Candidate endorsements will be viewed by users of eVoter. We do not guarantee that any particular functionality of Your Organization Profile and Candidate endorsements will be available at all times.
  13. We may pay part of your Purchase Price to a third party as a referral or affiliate commission. You agree that We have no responsibility to you to disclose such payments to third parties.
  14. We will communicate with you regarding Your Organization Profile and Candidate endorsements at the contact details You give us. Generally, we will only attempt to contact You by email. It is Your responsibility to make sure that Your email address (and other contact details) is correct and kept current. It is Your responsibility to ensure that Our emails are not blocked by any spam filters that your email system may have. On occasion, we may send system-wide emails only to your inbox on eVoter. You are responsible to check your inbox and Organization Profile control panel for system messages from time to time.
