Terms and Conditions for Purchasing a Candidate Profile

All purchases of Candidate Profiles on eVoter are subject to the following terms and conditions in addition to the general Terms and Conditions of eVoter (definitions in these Terms and Conditions are the same as in the general Terms and Conditions of eVoter):

1. Our current rates for a Candidate Profile are available on Our Price List. Our prices are determined by the size of the office. The price for a Candidate Profile is only due once per election (i.e. primary or general).

2. When You purchase a Candidate Profile from Us, You acknowledge that You are purchasing paid political advertising.

3. Purchases of Candidate Profiles may only be made by Candidates who have formed campaign committees and have received an ID number for such committee from the relevant election regulatory authority. Following the date on which Your relevant election authority has set a filing deadline for Your office, only official candidates for an office may purchase a Candidate Profile for that office on eVoter.

4. Payment for a Candidate Profile may be made only by:

4.1. Check from the Candidate's official campaign committee (made out to "eVoter Inc" and referencing Your Username. Mail checks to: eVoter Inc, Attn: Payments, 2028 Harrison St. Suite 108, Hollywood, FL 33020)

4.2. Credit Card in the name of the Candidate.

5. All purchases will be subject to verification by Us that (i) You are the Candidate you purport to be on eVoter and (ii) that Your campaign committee details are accurate. We will use our best efforts to verify your information within 3 business days. You agree to provide any additional information we require to perform such verification.

6. You will be able to edit and access Your Candidate Profile during the period when We are verifying Your information under Section 5, above. However, your Candidate Profile will not be visible to other users of eVoter until (i) We have completed verification of your information and (ii) your payment has been received and cleared.

7. You are responsible for all content on Your Candidate Profile. We will not edit or censor the content of Your Candidate Profile.

8. We will identify Your Candidate Profile as paid political advertising as required under the relevant campaign finance laws governing Your race (such as a notice on the bottom of Your Candidate Profile page stating "Paid for by..." in the proper format). However, if such identification does not comply with the relevant laws, You agree that it is Your responsibility to notify Us of such non-compliance and to inform Us how to make any corrections that are needed. We agree to promptly update Your Candidate Profile with the correct language/format.

9. If You opt to accept contributions on Your Candidate Profile through CT, You expressly acknowledge that You are soliciting contributions for your campaign committee and that we are not making any solicitations to users of eVoter on your behalf.

10. All purchases are final. No refund will be given if You wish to remove your Candidate Profile prior to an election, regardless of the reason for removal.

11. Following the election date for Your office, we will remove Your Candidate Profile from eVoter upon 10 business days emailed notice. If there is a further election for that office (i.e. You have won a primary and are now running in the general election), You will be invited to keep Your Candidate Profile for the subsequent election for an additional payment according to Our Price List.

12. We expressly disclaim any liability for any failure to display Your Candidate Profile for any technical reason whatsoever. We do not make any representations as to how many times Your Candidate Profile will be viewed by users of eVoter. We do not guarantee that any particular functionality of Your Candidate Profile will be available at all times.

13. We will communicate with you regarding Your Candidate Profile at the contact details You give us. Generally, we will only attempt to contact You by email. It is Your responsibility to make sure that Your email address (and other contact details) is correct and kept current. It is Your responsibility to ensure that Our emails are not blocked by any spam filters that your email system may have. On occasion, we may send system-wide emails only to your inbox on eVoter. You are responsible to check your inbox and Candidate Profile control panel for system messages from time to time.
